SAN FRANCISCO - A 4 year old should be allowed to eat a pot brownie, a South City mom allegedly told cops.
Marisela Guadalupe Barraza, 19, was arrested Monday, the day after her 4-year-old daughter ate one of her marijuana brownies, authorities said. Cops were notified after Barraza’s sister brought the child to the hospital.
Barraza allegedly told officers that it was not her fault because her child “ate it before she could stop her.” She also stated that it was “no big deal” and “marijuana should be legalized,” according to San Mateo County prosecutors.
After the child ate the brownie Sunday, Barraza brought her daughter to her sister’s house. Her sister noticed the child had “slow speech, droopy eyelids” and was “acting strangely,” San Mateo County Chief Deputy District Attorney Steve Wagstaffe said.
Barraza and her daughter spent the night at the 21-year-old sister’s home. Her sister brought the child to the hospital the next day, after consulting her mother while Barraza had temporarily left the home.
Blood tests showed marijuana in the child’s system, Wagstaffe said.
Cops were called. The sister told police that Barazza “was addicted to marijuana and acted irresponsibly with the child on prior occasions,” Wagstaffe said.
Barazza pleaded not guilty to a misdemeanor child endangerment charge Wednesday. The case was set for jury trial on Oct. 25.
The mother remains in custody on $7,500 bail
